Please read these Terms of Sale and Conditions of Use (the “Terms”) carefully before you access, use or place an order through our website. These Terms contain disclaimers of warranties and limitations of liability (see sections 15 and 16) and a dispute resolution section (see section 17). They form an essential basis of our agreement. Your use of oravite.com, including any sub-domains and any related pages we operate (together, the “Website”), is governed by the policies, terms and conditions set out below. The Website and the products sold on it are offered by Oravite (“Oravite”, “we”, “our”, “us”). We offer the Website, including all information, tools, products and services available from it, to you on condition that you accept all the terms, conditions, policies and notices stated here. By accessing or using the Website, or by placing an order through it, you agree to these Terms. If you do not agree to these Terms in their entirety, you are not authorised to use the Website.

We may update, change or replace any part of these Terms by posting updates on this page. It is your responsibility to check this page periodically. Your continued use of the Website after any change is posted constitutes acceptance of that change. Where a change materially affects an active subscription, we will notify you before it takes effect.

By using the Website and agreeing to these Terms, you confirm that you are at least the age of majority in your country, state or province of residence, that you have the legal capacity to enter into a binding contract with us, and that you have read and understood these Terms.

Our Privacy Policy describes how we collect, use and share your personal information. It is incorporated into these Terms by reference and forms part of them.

All aspects of the Website are protected by copyright, trademark and other intellectual property laws. You do not acquire any ownership or other rights by accessing the Website or downloading any material from it.

You agree not to use the Website, or any product or service, in any unlawful manner or for any unlawful purpose. In particular, you agree not to:

• attack, hack or otherwise interfere with the Website or its security features;
• publish vulgar, abusive, obscene or defamatory material;
• solicit others to perform or take part in any unlawful act;
• violate any applicable international, national, regional or local law or regulation;
• infringe our intellectual property rights or the rights of others;
• harass, abuse, insult, harm, defame, intimidate or discriminate against anyone;
• submit false or misleading information;
• upload or transmit viruses or any other malicious code;
• collect or track the personal information of others.

We may suspend or terminate your access to the Website if we reasonably believe that you have not complied with these Terms, have provided false, inaccurate or incomplete information, or have acted in a way that harms our rights or interests. We may also take any other action or seek any remedy permitted by law.

Products purchased from Oravite through the Website are for your personal, non-commercial use. You agree that you will not resell, redistribute, modify or export any product you order from the Website.

The material on the Website is provided for general information only. It is not medical or dental advice and is not a substitute for advice from a qualified healthcare professional. Oravite is a dietary supplement and is not intended to diagnose, treat, cure or prevent any disease. Consult your doctor or dentist before using any new supplement, especially if you are pregnant, breastfeeding, taking medication or have a health condition. Always read and follow the product label.

We try to keep the information on the Website accurate and current, but it may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct any error, inaccuracy or omission and to change or update information, or cancel orders, if any information on the Website is inaccurate at any time without prior notice, including after you have submitted an order.

We make every effort to display the appearance and packaging of our products accurately. What you see depends on your screen, and packaging may vary. Individual results vary depending on factors unique to you, and we do not guarantee that you will achieve any particular outcome.

We may modify or discontinue the Website, or any part or content of it, at any time without notice. We are not liable to you or any third party for any modification, suspension or discontinuance of the Website. Product descriptions and prices may change at any time without notice. Some products may be available only online and in limited quantities. Any offer made on the Website is void where prohibited.

All prices and charges are in US dollars unless the checkout shows a different currency. Before you pay, the checkout shows the products, applicable taxes, shipping charges and your total.

By submitting payment information, you confirm that you are authorised to use the payment method, that the information you provide is complete and accurate, and that sufficient funds are available. Payments are processed by third-party payment providers; we do not store your full card number. Our payment providers may receive updated card details from your card issuer when a card expires, in which case your stored payment method may be updated accordingly.

We are not responsible for fees or charges applied by your bank or card issuer. If a charge is reversed by your bank or card issuer, we may bill you directly and seek payment by another method. Charges will appear on your statement under the Oravite name or the name of our payment provider.

Your order confirmation email confirms that we have received your order; it does not signify our acceptance of it. We reserve the right to accept or decline any order for any reason, including product availability, suspected fraud, payment failure or a pricing error. If we decline your order, or an item becomes unavailable before we accept it, we will notify you as soon as possible and refund any payment to your original payment method. We may require additional information before processing an order.

Where available, you may buy a product once or enrol in our Subscribe & save programme. A subscription is billed automatically at the interval you chose, to the payment method you provided, until you cancel it. Subscribe & save takes 20% off the price of your chosen pack option, and the recurring price, shipping and tax are shown before you confirm.

You may skip, pause or cancel your subscription at any time before your next renewal date from your account, or by emailing support@oravite.com. Cancellation stops future renewals but does not cancel an order that is already being processed. Charges for renewals, including taxes, are charged to your payment method. Your renewal date may move if a payment does not settle or if you change your delivery interval.

We may change subscription plans or prices. Except where these Terms say otherwise, a price change takes effect only after we have notified you, and you may cancel before it applies.

We ship internationally to the destinations available at checkout. Please see our Shipping Policy for information on order processing, dispatch, tracking and carriers.

An accurate shipping address and contact details are required. We are not responsible for late or missing deliveries where you have entered incorrect address information. If you discover a mistake in your order, or wish to cancel it, contact support@oravite.com as soon as possible. We will try to help, but we cannot guarantee that an order can be changed or cancelled once it has been processed or dispatched.

Because many things can happen at a delivery address that are beyond our control, you agree that the carrier’s delivery confirmation is sufficient proof of delivery, even without a signature.

Oravite offers a 30-day money-back guarantee on your first order. If Oravite is not right for you, contact support@oravite.com within 30 days of the delivery of your first order for a refund of the product price, according to the terms in our Refund Policy. Opened packs are eligible. The guarantee applies once per customer and household and only to products purchased directly from the Website. Approved refunds are issued to the payment method used for the order.

Purchases that do not qualify for the money-back guarantee are subject to our standard Refund Policy, which forms part of these Terms. After we approve a refund and receive any required return, we aim to process the refund within 5 business days. Depending on your bank or card issuer, it may take a further 5 to 10 business days for the refund to appear on your account.

This section applies to everyone who interacts with our social media presence, including comment sections, feeds and other elements viewable on third-party social media platforms. Those platforms are not controlled by us and have their own privacy policies and terms of use. Comments and opinions expressed by users on social media are theirs alone and do not reflect the opinions of Oravite. We have no obligation to monitor or remove user comments. If you see an offensive or inappropriate post, please report it to the operator of the platform.

Except where prohibited by law, the Website and all products are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Website will meet your requirements, that it will be uninterrupted or error-free, or that the Website or the servers that make it available are free of viruses or other harmful components. Nothing in this section limits statutory guarantees that apply to consumers under the law of your country of residence.

Except where prohibited by law, Oravite and its owners, officers, employees, contractors and agents are not liable for any indirect, special, incidental, exemplary, consequential or punitive damages, or for any loss of profits, data, goodwill or use, arising from or related to these Terms, the Website, our products or your use of them, regardless of the theory of liability and even if we have been advised of the possibility of such damages.

If, despite the above, Oravite is found liable, our total liability to you for all claims relating to an order is limited to the amount you paid for the products in that order. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above may not apply to you, and you may have additional rights.

If you have a concern, please contact support@oravite.com first. Most issues can be resolved quickly and informally. You and Oravite agree to try in good faith to resolve any dispute informally for at least 30 days before starting formal proceedings.

These Terms are governed by the laws of the country in which Oravite is established, without regard to its conflict-of-law rules. If the mandatory consumer protection law of the country where you live gives you greater protection, that law also applies, and nothing in these Terms removes your right to bring a claim before the courts or dispute resolution bodies of your own country where the law gives you that right.

To the fullest extent permitted by the law that applies to you, any dispute that cannot be resolved informally will be resolved by binding individual arbitration or by the competent courts of the country in which Oravite is established, and you agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class, collective or representative proceeding. You may opt out of arbitration within 30 days of your first purchase by emailing support@oravite.com with your name, the product you purchased and a statement that you wish to opt out.

Oravite may seek injunctive or other equitable relief in any competent court to protect its intellectual property rights.

To the fullest extent permitted by law, you agree to indemnify, defend and hold harmless Oravite and its owners, affiliates, officers, employees, contractors, licensors, service providers and suppliers from any claim, loss, liability, damage, cost or expense, including reasonable legal fees, arising out of or connected with your breach of these Terms or the documents they incorporate, your breach of any representation in these Terms, or your violation of any law or the rights of a third party.

The Website may include materials from third parties or links to third-party websites. We are not responsible for third-party materials or websites. Please review the third party’s policies and practices before you engage in any transaction. Complaints, claims or questions regarding third-party products should be directed to the third party.

Anything you submit or post to the Website or provide to us, including photographs, testimonials, reviews, comments, ideas and suggestions (together, “Submissions”), is treated as non-confidential and non-proprietary. You grant us the right to use, copy, edit, publish, display and distribute Submissions by any means and in any form, and you confirm that you own or have sufficient rights to share them. Submissions reflect the experience of the individual customer and do not necessarily reflect the experience you may have. Reviews must describe your own genuine experience and must not include misleading health claims or other people’s personal information. We may correct, shorten or decline to publish any Submission.

All content on the Website, including text, images, photographs, graphics, illustrations, logos, designs, layouts, data and software (the “Content”), is owned by or licensed to Oravite and is protected by intellectual property laws. You may view, print or download Content for your personal, non-commercial use only, provided that you keep all copyright and other proprietary notices. You may not copy, reproduce, republish, distribute, sell, modify, create derivative works from or otherwise exploit any Content without our prior written consent. The Oravite name, logo and other marks displayed on the Website are trademarks of Oravite and may not be used without our prior written consent.

If you believe that material on the Website infringes your copyright, please email support@oravite.com with a description of the copyrighted work, the location of the allegedly infringing material, your contact details, a statement that you have a good-faith belief that the use is not authorised, and a statement that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner’s behalf. We will investigate and, where appropriate, remove or disable access to the material.

You agree that we may communicate with you electronically, and that notices, disclosures, agreements and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

You may not assign your rights under these Terms. Oravite may transfer its rights and obligations under these Terms if all or part of its business is transferred to another entity, by merger, sale of assets or otherwise.

Our failure to enforce any provision of these Terms is not a waiver of that provision or of our right to enforce it later. If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforced to the fullest extent permitted by law and the remaining provisions will remain in full force.

If these Terms are terminated, the sections that by their nature should survive, including sections 2 to 5 and 12 to 24, will survive termination.

These Terms, together with the policies incorporated by reference and any operating rules posted on the Website, constitute the entire agreement between you and Oravite regarding the Website and supersede any prior or contemporaneous agreements. Any ambiguity in these Terms will not be construed against the drafting party.
